“Suara penentangan di Sarawak semakin meningkat sejak permulaan gerakan ‘Sarawak for Sarawakians’ (S4S).

Malah ia kemudiannya diterima lalu digunakan oleh Allahyarham Pehin Sri Adenan Satem, Ketua Menteri Sarawak ke- 5, sebagai perjuangan utamanya, 'dijenamakan semula' sebagai 'Faktor Adenan'

Bagaimanapun, pentadbiran Adenan tidak bertahan lama, oleh kerana beliau meninggal dunia pada 11 Januari 2017. Beliau telah memegang jawatan selama kira-kira dua tahun sahaja.”

'Ketua Menteri Datuk Patinggi Abang Johari Tun Openg berkata ungkapan ikonik 'Jaga Sarawak bait bait' (jaga Sarawak sangat baik) oleh pendahulunya seharusnya menjadi inspirasi kepada rakyat Sarawak terutamanya pada masa ini apabila orang lain sedang mengintai untuk menguasai negeri itu. '

Dalam semangat perjuangan dalam hak MA63 dan bersumpah untuk melindungi serta menjaga Tanah Pameran Sekular Tercinta Sarawak, kata-kata Negarawan dan bekas Ketua Menteri kita yang dikasihi Pehin Sri Adenan Satem – 'Jaga Sarawak bait bait' (jaga Sarawak dengan baik) kekal sehingga hari ini .

“Ini Sarawak punya olang, bisi Melayu, bisi orang Cina, bisi orang Dayak, bisi orang Bidayuh, duduk sama, minum sama, makan sama, carik amoi pon sama.”

(Orang Sarawak ini, sama ada Melayu, Cina, Dayak, Bidayuh, mereka tinggal bersama, minum bersama, makan bersama, mencari pasangan bersama.)

Kemudian, Menteri Perumahan Datuk Amar Abang Johari Tun Openg berkata - “Hak Sarawak termaktub dan tertanam dalam Perlembagaan Malaysia dan Perlembagaan Sarawak. Jadi, kita mesti bersatu manakala Malaysia mesti kuat, dan Sarawak juga mesti kuat.

“Ini telah dipersetujui antara Borneo Utara, Sarawak, Singapura dan Persekutuan Tanah Melayu sebelum Perjanjian Malaysia ditandatangani pada 9 Julai 1963 di London,” katanya. [SUMBER: THEBORNEOPOST.COM PADA 25 OKTOBER 2015]

Abang Johari berkata, sambutan itu juga tertumpu kepada peristiwa bersejarah pada 1963 ketika Malaysia ditubuhkan, termasuk keistimewaan yang diberikan kepada Sarawak dalam perjanjian itu.

“Kami akan memaparkan perjanjian mengenai hak Sarawak yang mesti kami pertahankan di Malaysia. Kami mahu rakyat tahu bahawa Ketua Menteri Tan Sri Adenan Satem dan kerajaannya akan mempertahankan hak perlembagaan rakyat Sarawak," katanya. [Sumber: The STAR - Sabtu, 23 Jul 2016]

Ketua Menteri sekarang, Tan Sri Datuk Patinggi Abang Johari Tun Openg, menegaskan beliau adalah kapten baharu ‘Team Adenan’ untuk memperjuangkan pemulangan hak negeri seperti yang termaktub dalam MA63.

Namun, kita bingung apabila beliau kelihatan menyimpang daripada ‘semangat Pasukan’ yang berlandaskan prinsip ‘sekular’ Sembilan Prinsip Kardinal dan sejajar dengan Perlembagaan Negeri dan MA63.

YAB CM Abang Jo menyatakan bahawa “dengan perpaduan yang kukuh dalam kalangan rakyat dan berdasarkan persefahaman Piagam Madinah, Sarawak boleh dibangunkan untuk semua. Sebenarnya GPS (Gabungan Parti Sarawak) melakukan itu, yang berdasarkan Piagam Madinah.”

Inilah keunikan Sarawak dan ia mesti dipupuk. Abang Johari berkata adalah penting untuk membangunkan masyarakat berdasarkan apa yang terkandung dalam Piagam Madinah, pada masa yang sama mengamalkan keadilan untuk semua rakyat Sarawak walaupun berbeza kepercayaan mereka.”

Beliau berkata, “Di Malaysia, hanya Sarawak mempunyai unit untuk agama lain (Unifor) yang menjaga agama bukan Islam di negeri ini, dan ia dibiayai oleh Kerajaan Negeri. Melalui pendekatan sedemikian, ia akan memastikan keadaan politik Sarawak stabil. Ini kerana kami menghormati antara satu sama lain, dan ia membolehkan kami membawa kemajuan pembangunan yang adil untuk semua.”

Dengan semangat “jaga-jaga Sarawak bait bait” (jaga Sarawak sangat baik), kata-kata ini kedengaran agak hampa.

Pertama sekali, apakah kaitan ‘Piagam Madinah’ dengan Sarawak Sekular apabila Sembilan Prinsip Kardinal melambangkan maksud ‘perpaduan dalam kepelbagaian’ dalam konteks cara hidup penerimaan Sarawak yang tidak dicemari sebelum Malaysia wujud.

Sebaliknya, dengan memetik dasar tersebut, menerapkan prinsip semangat Piagam Madinah nampaknya lebih menyelaraskan Sarawak dengan agenda 'Ketuanan' Pas dan Unmo, yang secara kebetulan atau sebaliknya, telah menandatangani perjanjian. 'Piagam kerjasama' pada September 2021 berdasarkan Perlembagaan Madinah aka Piagam Madinah.

Bekas Setiausaha Agung Umno Annuar Musa menyatakan bahawa "piagam Umno-PAS dibina atas prinsip bahawa umat Islam di negara ini mempunyai hak dan kewajipan untuk mempertahankan Islam. Pada dasarnya, apa jua pendirian PAS Umno akan menyokongnya. Kita adalah sentiasa bersetuju,"

Dengan cara yang sama, kita boleh membuat kesimpulan bahawa GPS juga dalam persetujuan tersirat dan penjajaran dengan PAS dan UMNO mengenai ‘Piagam Madinah’ sebagai titik permulaan penyatuan umat Islam di negara ini, tanpa mengabaikan kepelbagaian bangsa”.

Di manakah mereka meletakkan Sarawak sebagai rakan pengasas yang sama dalam pembentukan Malaysia, dengan perlindungan dan jaminan seperti yang termaktub dalam MA63? Atau adakah Sarawak sepatutnya menjadi pengikut 'lemah lembut dan senyap' ibarat good for the goose is also good for the gander’ ?

Ini menimbulkan persoalan - ke manakah semua ini membawa kepada konteks 'penyatuan umat Islam di negara ini'?

Adakah 'penyatuan Malaysia' akan terus mengambil jalan Negara Sekular yang dijanjikan oleh Rakan Kongsi dan Bapa pengasas, berdasarkan Perjanjian Malaysia yang telah dimasukkan ke dalam Perlembagaan Persekutuan kita untuk menjamin hak dan kebebasan orang bukan Islam untuk mengamalkan kepercayaan mereka dan cara hidup sedangkan Islam kekal sebagai agama rasmi negara ?

'Menjadi atau tidak menjadi' - jika peristiwa baru-baru ini merupakan petunjuk, kita tidak boleh mengabaikan tanda-tanda dan gejala, dan hala tuju Malaysia perlahan-lahan tetapi pasti menuju - 'pemerintahan Islam' atau 'Negara Islam' - dari ' Allah' kepada isu 'Timah Whisky' baru-baru ini kepada pengharaman terbaharu perjudian di Kedah pimpinan Pas yang jelas menimbulkan kebimbangan dan keresahan yang tidak perlu di kalangan masyarakat bukan Islam.

Sehubungan dengan itu, rakyat Sarawak tidak boleh lupa bahawa PAS kini sebahagian daripada kerajaan persekutuan berkat sokongan Abang Jo dan GPS dalam menyokong Gabungan PN yang rapuh. Rakyat Sarawak mesti mempertimbangkan dengan serius sama ada untuk membenarkan GPS terus mentadbir kita kerana kita mengemukakan soalan ini kepada semua dan pelbagai - apakah 'kebaikan' yang boleh diperoleh daripada hubungan Gabungan dari Negara Sekular yang berbilang kaum dan agama dengan berkongsi perkara yang sama dasar politik dengan Parti berasaskan Malaya yang didorong oleh kaum dan agama ?

Atau adakah mereka berkongsi agenda bersama dan 'kesatuan dalam tujuan' untuk "Islamisasi dan Malayanisasi' Sarawak?

Oleh itu, kita tidak perlu mengingatkan bahawa unta itu tidak lagi meredah bukit pasir Arab Sauditetapi datang tepat ke tanah “ Sarawak Fairland. Malah, unta itu telah pun mencucuk hidungnya ke dalam khemah Sekular Sarawak seiring dengan pepatah Arab bahawa "Jika unta sekali masuk ke dalam khemah, badannya akan segera menyusul."

CM kita juga turut sama mengangguk dengan menyebut Piagam Madinah sebagai 'jalan ke hadapan dalam mentadbir Sarawak'. He appears serious enough and lest we forget his “kalau saya cakap bohong, lidah saya kena potong” remark.

Pastinya itu bukan dibuat secara bergurau, bukan?

Adakah kita suatu hari nanti akan diklasifikasikan sebagai 'orang beriman' dan 'tidak percaya'?

Hanya masa yang akan menentukan – tetapi arwah Tok Nan tidak mempunyai apa-apa.

Adakah anda rasa sedemikian, wahai rakan-rakan Sarawak?

Let’s face it – ‘Abang Jo the Politician’ is NOT ‘Adenan the Statesman’

“The voice of dissent in Sarawak picked up momentum ever since the dawn of the ‘Sarawak for Sarawakians’ (S4S) movement.

In fact it was later adopted by the late Pehin Sri Adenan Satem, the fifth Chief Minister of Sarawak, as his main struggle, ‘rebranded’ as ‘The Adenan Factor’

However, the Adenan administration was short-lived, following his untimely death on January 11, 2017. He had held office for about two years only.”

‘Chief Minister Datuk Patinggi Abang Johari Tun Openg said the iconic phrase ‘Jaga Sarawak bait bait’ (take very good care of Sarawak) by his predecessor should serve as inspiration for Sarawakians particularly at this present time when others are eyeing to control the state.’

Lest we forget…..

In the spirit of MA63 and sworn to protecting and safeguarding our Beloved Secular Fairland Sarawak, the words of our beloved Statesman and former Chief Minister Pehin Sri Adenan Satem – ‘Jaga Sarawak bait bait’ (take very good care of Sarawak) hold true till today.

“Ini Sarawak punya olang, bisi Melayu, bisi orang Cina, bisi orang Dayak, bisi orang Bidayuh, duduk sama, minum sama, makan sama, carik amoi pon sama.”

(These Sarawakians, whether they are Malays, Chinese, Dayak, Bidayuh, they live together, drink together, eat together, find partners together.)

Then, Housing Minister Datuk Amar Abang Johari Tun Openg said - “Sarawak’s rights are enshrined and embedded in the Malaysian Constitution and Sarawak Constitution. So, we must be united while Malaysia must be strong, and Sarawak must be strong.

“This was agreed upon among North Borneo, Sarawak, Singapore and the Federation of Malaya before the Malaysian Agreement was signed on July 9, 1963 in London,” he said.  [SOURCE: THEBORNEOPOST.COM ON OCTOBER 25, 2015]

Abang Johari said the celebration also focused on historical events in 1963 when Malaysia was formed, including the special privileges accorded to Sarawak in the agreement.

“We will display the agreement on Sarawak's rights which we must defend in Malaysia. We want the people to know that Chief Minister Tan Sri Adenan Satem and we in the government will defend the constitutional rights of the people of Sarawak," he said.   [Source: The STAR - Saturday, 23 Jul 2016]

Lest we also not forget…….

The current Chief Minister, Tan Sri Datuk Patinggi Abang Johari Tun Openg, has asserted that he is the new captain of ‘Team Adenan’ to fight for the return of the State’s rights as enshrined in the MA63.

However, we are perplexed when he appeared to deviate from the ‘Team’s spirit’ which was premised on the ‘secular’ principles of the Nine Cardinal Principles and aligned with the State Constitution and the MA63.

YAB CM Abang Jo stated that “with strong unity among the people and based on the Medina Charter understanding, Sarawak can be developed for all. Actually GPS (Gabungan Parti Sarawak) is doing that, which is based on The Charter of Medina.”

This is the uniqueness of Sarawak and it must be nurtured. Abang Johari noted it is important to develop society based on what is contained in the Medina Charter, at the same time practising fairness for all Sarawakians despite their different beliefs.”

He said that “in Malaysia, only Sarawak has the unit for other religions (Unifor) which takes care of non-Islamic religions in the State, and it is funded by the State Government. Through such approach, it will ensure a stable political situation for Sarawak. This is because we are respecting each other, and it has enabled us to bring fair development progress for all.”

In the spirit of “jaga-jaga Sarawak bait bait” (take very good care of Sarawak), these words sound rather hollow.

First and foremost, what has the ‘Medina Charter’ to do with Secular Sarawak when the Nine Cardinal Principles epitomises what ‘unity in diversity’ means in the context of Sarawak’s unadulterated acceptance way of life way before even Malaysia came into being.

On the contrary, by quoting and in essence, applying the principles and spirit of the Medina Charter it appears more to bring Sarawak in alignment with Pas and Unmo’s ‘Ketuanan’ agenda, who had, by sheer coincidence or otherwise pre-planned, signed a ‘cooperation charter’ in September 2021 based on the Constitution of Medina aka The Medina Charter.

Former Umno Secretary-General Annuar Musa stated that "the Umno-PAS charter is built on the principle that Muslims in this country have the right and obligation to defend Islam. In principle, whatever PAS' stand is, Umno will support it. We are always in agreement,"

By the same token, we may conclude that GPS is also in tacit agreement and alignment with Pas and Umno on the ‘Medina Charter’ as the starting point for the unification of Muslims in the country, without ignoring the nation's diversity”.

Where does that put Sarawak as an equal founding partner in the formation of Malaysia, with the safeguards, protection and assurances as enshrined in MA63 ? Or is Sarawak supposed to be just a ‘meek and silent’ follower of what is good for the goose is also good for the gander’ ?

This begs the question – where do all these lead to in the context of ‘unification of Muslims in the country’?

Will the ‘unification of Malaysia’ continue to take the path of a Secular Country promised by the founding Partners and Fathers, premised on the Malaysia Agreement that was incorporated into our Federal Constitution to guarantee the rights and freedom of non -muslims to practise their beliefs and way of life while Islam remains the official religion of the country ?

‘To be or not to be’ -  if recent events were any indication, we cannot ignore the signs and symptoms, and the direction that Malaysia is slowly but surely heading towards - ‘islamic rule’ or an ‘Islamic State’ – from the ‘Allah’ to the recent ‘Timah Whiskey’ issue to the latest ban on gaming in Pas-led Kedah which had obviously caused unnecessary worry and anxiety among the non-muslim communities.

On that, Sarawakians must not forget that Pas is now part of the federal government thanks largely to the support of Abang Jo and GPS in propping up the fragile PN Coalition. Sarawakians must seriously consider whether to allow GPS to continue governing us as we pose this question to all and sundry – what ‘good’ can come out from the relationship of a Coalition from a multi-racial and multi-religious Secular State by sharing the same political bed with Malayan-based Parties driven by race and religion ?

Or are they sharing a common agenda and ‘oneness in purpose’ for the “Islamisation and Malayanisation’ of Sarawak ?

That said, we need no reminding that the proverbial camel is no longer trekking the sand dunes of Saudi Arabia but is coming right to the shore of Fairland Sarawak. In fact, the camel has already poked its nose into Sarawak’s Secular tent in tandem with the Arab proverb that "If the camel once gets his nose in the tent, his body will soon follow."

Our CM has also nodded the same by citing the Medina Charter as the ‘way forward in administering Sarawak’. He appears serious enough and lest we forget his “kalau saya cakap bohong, lidah saya kena potong” remark.

Surely that wasn’t made in jest, was it ?

Would we one day be classified as ‘believers’ and ‘non-believers’ ?

Only time will tell – but the late Tok Nan would have none of it.

Would we, fellow Sarawakians ?

It would have been a real meaningful message if he said Sarawak is grateful that the federal government has decided and has started the process of returning all of Sarawak’s lost rights.

Interestingly Abang Johari alluded to the fact that the MA63 is the foundational document upon which Sarawak’s rights vis-a-vis the federal government were created. And, it was provisions in the federal constitution and other Acts of parliament that usurped Sarawak’s rights.

To cut this straight to the bone, I will say just this : Sarawak has nothing to be thankful to the federal government as far as her rights are concerned.

How did Sarawak loses her rights in the first place? The short answer to that is through the August 1976 amendment to the federal constitution.

When Malaysia was formed on Sept 16, 1963 (before August 1976) the federal constitution read: “the States of the Federation shall be – (a) the States of Malaya, namely, Johore, Kedah, Kelantan, Malacca, Negeri Sembilan, Pahang, Penang, Perak, Perlis, Selangor and Trengganu; and (b) the Borneo States, namely, Sabah and Sarawak; and (c) the State of Singapore.”

In short, there were three (3) territorial entities involved - Malaya, the Borneo states and Singapore.

After August 1976, Article 1(2) says: “The States of the Federation shall be Johore, Kedah, Kelantan, Malacca, Negeri Sembilan, Pahang, Penang, Perak, Perlis, Sabah, Sarawak, Selangor and Terengganu.”

The Borneo states of Sabah and Sarawak were reduced in status to a mere state in the federation. Why is this significant?

To put it simply, before August 1976, Sarawak was a ‘sovereign state within a federation’ a little like the UK within the EU. Because the UK was a sovereign state, it  was able to do a Brexit when it realized that the EU was not in their best interest. By being a mere state within the federation, Sarawak’s position was reduced to a cow being led by its nose.

That was and still is the reason why the restitution for losses and restoration of rights over Sarawak’s natural resources, chief among which is the oil and gas, is not even a work in progress.

How did the August 1976 amendment to the federal constitution happened? It was because of the betrayal of Sarawak’s MPs from the Barisan Nasional (BN) government block  in parliament. They voted for it.

When the Malaysian Agreement 1963 (MA63) and the status of the Borneo States became a sexy thing in Malaysian politics, particularly in Sarawak and Sabah after the GE12 in 2008, the then Pakatan Rakyat coalition made it their clarion call in these two Borneo states. The awareness of the betrayal by BN MPs from Sarawak was raised to much higher levels and the Sarawak BN government was left with no choice but to hijack the issue and attempted to champion it. Unfortunately for them the rot has set in to a degree which they cannot cover up with cosmetic actions.

The litmus test came in 2019 when the Pakatan Harapan proposed an amendment to the federal constitution. That amendment would have set in motion the process of restoring Sarawak’s lost rights but it failed. It failed because Sarawak’s MPs from GPS decided to perpetuate the tradition of betraying Sarawak - they abstained from voting in parliament.

Wikipedia recorded this betrayal in these words ‘ On 4 April 2019, a bill proposing an amendment to the Constitution of Malaysia was tabled in the Dewan Rakyat of the Parliament of Malaysia. The bill proposed to amend Article 1(2) so as to restore the status of the two East Malaysian states of Sabah and Sarawak according to the original content of Malaysia Agreement that was signed in 1963.

Despite six hours of debate in the Parliament during the second reading of the bill on 9 April, only 138 MPs supported the bill, 10 votes short of the two-thirds majority of the chamber, 148 votes, required for amendments to the Constitution. The remaining 59 (non-absent) votes were abstentions, all of which are from opposition parties’

So what exactly has the GPS government of Sarawak achieved in the efforts to get the Malaya-led federal government to restore Sarawak’s lost rights and get restitution for the losses suffered since Sept 1963? Nothing at all. Can 2 onshore natural gas concessions, yet to be proven to contain viable reserves of untapped natural gas, compare to a proven oil field (E11) over which the production sharing contract (PSC) has recently expired and then given to Petronas Carigali to continue to exploit? Can the distribution rights to LNG compare to that?

In the final analysis, it boils down to this : For as long as you choose to be an ulun Malaya, you will remain as a cow that is led by its nose. You can never be the rampaging bull determine to mark out its territory and all that is his.

Now we come to the biggest question here? Was there really something to celebrate on Sarawak’s Independence Day yesterday? Your answer will tell you which way your votes will go in the coming pilihan raya negeri.

Sudah-sudahlah menipu dan janganlah hendak berdolak-dalih lagi. Carilah kebenaran dan permasalahan sebenar punca kekacauan ini dan lakukan apa yang mesti anda lakukan untuk memperbaiki perkara yang salah, jika ada kesopanan dan keikhlasan dalam diri anda. Ini adalah pertaubatan dan pemulihan bagi anda.

Senarai di bawah adalah salah satu dosa anda terhadap rakyat Sarawak, keburukan yang anda tinggalkan:

1. MA63

Ini bukanlah undang-undang, yang pastinya, ketika matahari terbit di timur dan terbenam di barat, dokumen ini mempunyai kesan undang-undang. Umum mengetahui, wujudnya Perlembagaan MA63 bermaksud Sarawak bersetuju untuk mewujudkan Malaysia bersama-sama. Tunku Abdul Rahman (TAR) dan rakan-rakannya dari UMNO tidak menghiraukan syarat MA63 dari hari pertama dan di saat itu jugalah  kejatuhan Sarawak kian berlaku seperti apa yang berlaku  sekarang. Kesalahan siapa? Nenek moyang anda di Berjasa / Bumiputra. Oleh sebab mereka alpa dan lalai, mereka bersekongkol dengan pemimpin Tanah Melayu.

 2. Pemecatan Stephen Kalong Ningkan, CM pertama Sarawak

Ketua Menteri Pertama Sarawak Stephen Kalong Ningkan (SKN) dipecat dari pejabat dalam gerakan yang dipimpin oleh TAR. Kesalahan siapa? Ianya adalah kesalahan moyang anda iaitu Tun Abdul Rahman Yaakub (TARY). Dia menghasut TAR untuk memberhentikan SKN kerana SKN ingin meminda Kanun Tanah Sarawak untuk melindungi tanah NCR orang Dayak. Dia disokong oleh para pemimpin.

 

3. 1976 Pindaan Perkara 1 (2) Perlembagaan Persekutuan

Pindaan tahun 1976 terhadap Artikel 1 (2) perlembagaan Persekutuan menurunkan status Sarawak menjadi negeri, status yang sama dengan Perlis atau Kelantan di Tanah Melayu. Sekarang anda menangis dan menyesali dengan apa yang telah berlaku. Itupun hanya kerana ianya mengancam jawatan yang akan diperoleh andaKesalahan siapa ini? Rakan seperjuangan sebelum anda, diketuai oleh TARY dan Pek Moh.

 4. PDA 74

Melalui PDA 74, Sarawak kehilangan semua hak ke atas sumber minyak dan gas. Namun, Sarawak hanya mendapat royalti 5% sahaja sebagai balasan dan perkara ini amat menyedihkan sekali. Kesalahan siapa ini? Tun Abdul Rahman Yakub. Dia mencadangkannya kepada pemimpin Tanah Melayu dan menolong mereka agar undang-undang tersebut diluluskan.

5. Akta Wilayah Laut 2012

6. Pakatan Harapan (PH) Berusaha Menyelaraskan Perlembagaan Persekutuan kepada MA63

Pada bulan April 2019, Kerajaan PH memperkenalkan rang undang-undang kerajaan di parlimen, untuk meminda Art 1 (2) perlembagaan persekutuan sehingga menyelaraskannya dengan MA63. Itu adalah peluang keemasan untuk memperbaiki beberapa kesalahan yang dilakukan terhadap Sarawak. Rang Undang-Undang GAGAL dan tidak berhasil diperbaiki.

Dosa siapa ini? Anda dan rakan anda dalam GPS (sebelumnya BN Sarawak). Mereka ambil keputusan untuk tidak mengundi di dalam hal RUU itu , malah mengabadikan tradisi BN / GPS untuk mengkhianati Sarawak.

Sekarang anda membawa perdebatan mengenai ' Wilayah' , Region dan Territory ke pengadilan pendapat umum dan berusaha menarik perhatian orang-orang Sarawak. Sekarang anda mengatakan PM Mahiaddin akan segera memperbaiki perkara yang salah, semua ketika parlimen digantung.

Anda terus menganggap rakyat Sarawak bodoh membuat saya sangat marah. Perkara itu termasuklah berusaha meyakinkan orang-orang Sarawak bahawa keadaan darurat yang sedang kita jalani sekarang adalah untuk kebaikan negara dan bukan untuk anda berbuat lebih banyak lagi pengkhianatan.

It Is Legacy We Want Not Infamy

Cut through the bullshit man. Get to the core of this mess and do what you must do to right the wrong, if there is any decency and sincerity in you. It is both repentance and restitution for you.

These are among your sins against Sarawakians, the infamies you are leaving behind :

 1. MA63

This is not law but as certain as the sun rises in the east and sets in the west, this document has legal effect. It was the foundation upon which Sarawak agreed to co-create Malaysia. Tunku Abdul Rahman (TAR) and his comrades from UMNO ignored the terms of MA63 from day one and started Sarawak's fall into the mess that we are in now.

Whose fault? Your forebearers in Berjasa/Bumiputra. By their negligence they conspired with Malaya leaders.

 2. Sacking Of Stephen Kalong Ningkan, Sarawak’s 1st CM

Sarawak 1st Chief Minister Stephen Kalong Ningkan ( SKN ) was sacked from office in a move engineered by TAR.

Whose fault? Your forebearer Tun Abdul Rahman Yaakub ( TARY ). He instigated TAR to dismiss SKN because SKN wanted to amend the Sarawak Land Code so as to protect dayaks' NC land. He was supported by the leaders of

 

3.  1976 Amendment To Article 1 (2) Of The Federal Constitution

A 1976 amendment to Article 1 (2) of the Federal constitution demoted Sarawak's status to a state, same status as Perlis or Kelantan in Malaya. Now you are crying over split milk but only because it threaten your incumbency.

Whose fault was this? Your predecessors, led by TARY and Pek Moh.

 

4.  PDA 74

Through PDA 74, Sarawak completely lost all her rights to her oil and gas resources. In return for surrendering her rights, Sarawak was to get a miserable 5% royalty.

Whose fault was this? Tun Abdul Rahman Yakub. He proposed it to Malayan leaders and helped them to get the law passed.

 

5. Territorial Sea Act of 2012

The Territorial Sea Act of 2012 reduced Sarawak's Continental Shelf from 12 nautical miles a mere 3 nautical mile from shore, giving the federal government full rights to all the natural resources outside the 3 nautical mile line.

Whose fault was this? You and your comrades from BN Sarawak.

 

6. Pakatan Harapan (PH) Attempt To Align The Federal Constitution To MA63

In April 2019, the PH government introduced a government bill in parliament, to amend Art 1 (2) of the federal constitution so as to align it to the MA63. That was a golden opportunity to right some of the wrongs done to Sarawak. The bill FAILED and nothing came out of it.

Whose sin was this? You and your comrades in GPS (previously BN Sarawak). They abstained from voting and perpetuated BN/GPS's tradition of betraying Sarawak.

Now you take the debate over ' Wilayah' , Region and Territory to the court of public opinion and attempt to pull the wool over Sarawakians' eyes. Now you say PM Mahiaddin will soon right the wrong, all when parliament is suspended.

That you continue to assume Sarawakians are stupid makes me so angry. And that includes trying to convince Sarawakians that the Emergency we are in now is for the good of the country and not to keep you bunch of pengkhianat in office.

Well, Sarawakians are much much more aware of political on-goings these days and I am confident they will throw you out in the coming PRN.

‘Sarawak has sound financial and resource management and this has helped the state to implement various development projects.

                 Chief Minister Datuk Patinggi Abang Johari Tun Openg pointed this out at a community                           dinner  held at the Kapit Civic Centre on Sunday evening (Oct 4th 2020)’

Those were the opening lines in a news report captioned  ‘State has sound financial, resource management’ and carried by the New Sarawak Tribune dated the 5th Oct 2020.

The claim is something all Sarawakians would be proud of it was a completely truthful statement. Unfortunately, truth sometimes can be stranger than fiction and in this case, it is a fiction worthy of a literally award. The only thing that Sarawakians will agree about in the matter of financial management is Sarawak finances is shrouded in secrecy.

In June 2018, shortly after the GE14 in which the Pakatan Harapan (PH) showed Barisan Nasional (BN) the exit door, Sarawak DCM Tan Sri James Masing was reported as having said the the Sarawak BN government should use up all the state’s reserve in the amount of RM31 billion for projects before the PRN12. That was the first and the last time Sarawakians ever heard of the financial strength of the Sarawak government because after that revelation from James Masing there was no farther mention from any of the government leaders including from the chief minister himself. Indeed, I am inclined to think that most of GPS ADUNs including assistant ministers do not know of the existence of the reserve.

Sufficiently piqued by this revelation Sarawakians are now asking where is the money kept. It would not be logical to assume that the entire RM31 billion is kept in low interest paying bank accounts as that would not exactly be sound financial management. So where is the money spread? Treasury Bills, Malaysian Government Securities, Stock & Shares? Real Estate Investments?, Bonds like the 1MDB Bonds? If a significant portion of the reserve is kept in forms other than cash, then what is the current market value now? Is the RM31 billion still there? 

Sarawakians are asking because what they know of from information in public domain does not dovetail with this ‘brief flash in the pan’ revelation from James Masing. There was for example the issuance of USD1.6 billion through Goldman Sachs in 2011 and 2012:  US investment bank Goldman Sachs appears to have turned a blind eye to glaring corruption risks and conflicts of interest in order to underwrite US$1.6 billion in bonds for the Sarawak State Government, Malaysia, said Global Witness today (1). https://www.globalwitness.org/en/archive/goldman-sachs-underwrites-us16-billion-under-radar-bonds-corrupt-sarawak-regime-and-wins/

The scandal ridden jiwa murni roads in central and northern regions of Sarawak is another example which speaks of the possibility of the reserve not existing at all. The jiwa murni roads were crucial network of roads that was intended to provide rural communities with road connectivity. We now know that the ‘contracted’ sum was RM800 million which was less than a billion ringgit. Why did the Sarawak government not use the reserve to construct these roads, so crucial to the well-being of the rural folks? Not to mention the 24 hours electricity and treated water supply to communities that are still deprived of these most basic of utilities. Good financial management would have dictated that financing for these projects would be through sources carrying the smallest interest or opportunity cost burden to the state government and raising funding through issuance of bonds is definitely not the best option.

The Development Bank Of Sarawak (DBOS), incorporated in May 2016 and commenced business in Jan 2018 is one page from the annals of the financial management of the Sarawak government which raised many questions among Sarawakians. The following is an excerpt from a news report carried by Borneo Post on the 13th Jan 2019 :

‘As of Oct 23 last year, DBOS holds a total deposit of RM3.448 billion with credit facilities approved and disbursed standing at RM350 million and RM244 million, respectively.

Assistant Minister of Corporate Affairs Abdullah Saidol said the depositors are government-linked companies (RM7.5 million), local authorities (RM17.6 million), statutory bodies (RM23.2 million), and the public sector (RM3.4 billion)’

At that time DBOS had in their books deposits totaling RM3.448 billion, all from the Sarawak government, directly or indirectly and a paid-up capital of RM1 billion.

On the 13th Jan 2020 DBOS homepage published a media statement in which they said ‘ Besides this, he (Sim Kheng Boon,CEO of DBOS) said DBOS had already approved loans amounting to a few billion ringgit. Aside from financing mega development projects, the bank also finances smaller infrastructure projects……“DBOS will offer banking facilities to eligible borrowers which have at least 51 per cent state equity with management control.’

The last sentence quoted here presented at least one area of concern which is that, among the eligible borrowers are those with 51% state equity with the balance of 49% being privately held. What it means here is that DBOS was set up to help finance (with state funds) private business people. Here we are talking about financing for the elites, the privilege few who are able to dip their hands into the 49% share in these very lucrative areas.

An article published in the Home Page of Sarawak’s DAP reveals some names which should ring many alarm bells.

Next is Petroleum Sarawak Berhad (Petros), another wholly state-owned enterprise incorporated on the 6th March 2018. Petros presently has an issued and paid-up capital of RM20 million. 

In the words of CM Datuk Patinggi Abang Johari, it was set up by the state government to enable Sarawak to actively participate in the extraction of oil and gas in Sarawak. The thinly veiled objective was to increase the revenue stream from the oil and gas sector as the federal government was saying signs that it will not bow to Sarawak’s demand for an increase in oil loyalty.

What significant success has Petros achieved since incorporation? It was reported in Feb 2020 that Petros has assumed the role of gas transporter and aggregator in Sarawak effective this year following the sales and purchase of gas distribution business and assets in Miri and Bintulu.

Petroleum Sarawak Gas Sdn Bhd (Petros Gas), a subsidiary of Petros, is now the operator of Miri Gas Distribution System (MGDS) and Bintulu Gas Distribution System (BGDS). Both facilities were previously owned and operated by PETRONAS Gas Berhad (PGB), a subsidiary of Petronas.

How much is the segment worth yearly to Sarawak or how much did Sarawak compensated Petronas for it was never revealed. What we do know is PDA74 is still very much relevant in the oil & gas industry and will remain as a major damper on CM Abang Johari’s ambitions for Petros and for the ROE and ROI of Petros. 

And there is the matter of the SST payout of RM2.95  billion by Petronas. Sarawakians were told on the 17th Sept 2020 that Petronas has paid to the Sarawak government the sum of RM2.95 billion in court-awarded SST on O&G products. Nine days later, Sarawakians were told that the Sarawak government has agreed to buy all of Tabung Haji oil palm estates in Sarawak. The consideration price was not mentioned but a 2019 valuation of the estates placed the fair value at RM1.42 billion. 

In the final reckoning it was a case of the federal government, through Petronas, putting money through Sarawak’s left pocket and taking it back through the right pocket via the Tabung Haji’s rescue plans. Whether or not there was some arm twisting there is unknown but Sarawak certainly was short changed.

And that, to my mind are unacceptable blunders in the managing of both the state’s financial and natural resources.

The news headline in the Borneo Post edition of the 4th October 2020 read, ‘Have new timber policy ‘to benefit all’, says Nanta’ He went on to say,’ “Therefore, l hope that Chief Minister Datuk Patinggi Abang Johari Tun Openg would come out with a new policy that could benefit the ordinary people, and not only the rich people,  Nanta, who is also Parti Pesaka Bumiputera Bersatu (PBB) secretary-general, in his welcoming address for the ‘Special PBB Convention-Central Zone at a hotel here yesterday.

If these words were to come from somebody other than Alexander Nanta Linggi it would have attracted almost no attention at all. Firstly, who is Alex Nanta Linggi? He is none other than the heir to the Linggi fortune, and thence lay claim to being the richest Iban in the world. He is also the son in law to the late Tan Sri Celestine Ujang a former Vice President of PBB. For his part in the downfall of the PH government in March 2020, Alex Linggi was appointed to the  Perikatan Nasional Cabinet under Prime Minister Muhyiddin Yassin, and is currently the Minister of Domestic Trade and Consumer Affairs. Clearly he is establishment and elitist in every sense of the word. 


          


                          The family flagship company, Rajang Wood Sdn Bhd,is among the earliest                                                recipients of timber concessions dished out to politically useful families by                                              the  late Tun Abdul Rahman Ya’akub, the then chief minister of Sarawak.                                                  Rajang Wood Sdn Bhd is a timber trading company incorporated in January                                              1978. It is recorded to hold 309575 hectares in concessions throughout                                                      Sarawak (Singapore totals 71,910 hectares in size) it must also be said that                                                they were never operated downstream, and basically just contracted out and                                              earn profit from there without having to do any work. The archetypical rent                                              seeker.

In short, the Linggi family has benefited and prospered for 42 long years from the timber concessions given to them. Given this clear advantage, the family has also ventured into plantations and in 2014 sold Asia Plantations Ltd which controlled a total 24,622ha comprising five wholly-owned estates within Miri and Bintulu in Sarawak to UMNO related Felda Global Ventures. The sellers reportedly pocketed a cool RM1,016,000,000.00 (RM628 million, and assumed RM388 million in liabilities*). 


The sale is now a subject of investigation for manipulation , a report by the Edge quoted an insider source as saying “Several things triggered the investigation, but what started the ball rolling is that another plantation company — a big one, much like FGV, and also government-linked — was offered Asian Plantations at RM20,000 per hectare … FGV ended up paying in excess of RM65,000 per hectare”

The family also owns Keresa Plantations Sdn Bhd (Co. No. 74447-V) which controls  8,551 hectares (ha) in Labang district between Bintulu and Belaga.  A news report carried by The Star on the May 2003 revealed that Keresa Plantations Sdn Bhd was awarded the subject land lease by Sarawak Government. An apparent form of reward for the Linggi’s family loyalty to PBB

Through a web of convoluted financial arrangements and off shore companies, how much wealth exactly has the Linggi family accumulated, would need a team of accountants to figure out. It would easily run into billions from a rudimentary visual inspection of the real estate they control today. Some of the visible signs are the Menara Tun Jugah in the middle of Kuching city, the Green Heights Mall in the Green Heights commercial and residential area and the Cove 55 property in Santubong.


So when Datuk Alexander Nanta Linggi proposed that timber policies be revamped so as to directly benefit the rakyat, His proposal was greeted with raised eyebrows and disbelief, because for close to half a century, the timber industry benefited only a handful of Sarawak’s elite families of which the Linggi family was and still is a member. 




All things considered he is so rich, with his family owning luxurious properties, expensive yachts, and rubbing shoulders with the cream of society. Meanwhile his community, the Dayaks are suffering in poverty without basic necessities and decent education.  One would surely be forgiven for asking, is this pronouncement “A tiger declaring to be vegetarian?”

But to observers with keen eyes, the proposal may not be the saving grace that it is touted to be. Chief Minister Abang Johari, speaking after officiating at the PBB mini convention said, “What has been proposed is that we look into our logging policies … which we want to improve because what is emphasised is to replant our forest and to see whether community involvement in the industry can be considered,” If reading this statement gives one the feeling of dejavu it is because there has been other land developments in which community involvement was experimented with, SALCRA being the most obvious. Has the community, the land owners within the plantation benefited from the land schemes? Easily 90% of NCR land owners in SALCRA plantations derived on the intermittent and inconsistent dividends. In the mills serving the plantation, the land owners are given 0% stake.


Now, Alexander Nanta Linggi is talking about reforming policies which, if crystallize and implemented, will affect land which they have controlled over through the provisional leases (PL) given to them. These lands are not NCR lands so the people will have no stake at all in these lands unlike in SALCRA schemes. So it is near impossible to visualize how the local people can participate and benefit from the reforms being proposed. At most, the local people will continue to work for Linggi family and the other PL holders as laborers earning the minimum wage prescribed by the law. They will  just be helping PL holders like the Linggi family to further enrich themselves.


The key to understanding this sudden intention to reform timber policies is found in the 9th paragraph of the New Sunday Tribune news captioned “Call To Revamp Timber Industry”. The wordings of that paragraph clearly show that the announcement is to intimidate parties who are no longer aligned to them to them politically. Innocent parties who have refused to participate in the continuing “wayang kulit” to fish for votes from an unsuspecting electorate.  


This coupled with the fact that the announcement is part of a pre-election road show by Abang Jo, more or less confirm this is another one of those “air liur” pronouncements. Such pronouncements like, hydrogen buses, LRT, DBOS etc. have become part and parcel of the rheotoric of this administration.

 

Further It is also well known in PBB circles that Abang Jo’s dayak support consist of Linggi Jugah’s cabal, while Abang Jo continue to facilitate the family’s interests, including insisting on a cabinet -position for Alex Nanta Linggi within the GPS UMNO PAS federal coalition.  This marriage of convenience between the two started when the timber concessions held by Rajang Wood Sdn Bhd were not autonomically renewed by the previous CM, to prevent this and in exchange for patronage, they had agreed to side with Abang Jo within the PBB “game of thrones”. This worked nicely for Abang Jo, who needed this support within the party grassroots. The same grassroots who otherwise had always viewed him as unsophisticated & somewhat lacking and wholly unsuitable to be Chief Minister. 

Now we are here, with both of them “you scratch my back, I scratch your back” in full view of a disgusted public. Fortunately, Hot Air is not easy to conceal and when there is little effort to conceal it, it become visible immediately.

Still, there is also the possibility that Alexander Nanta Linggi is suffering an attack of the conscience and is sincere in wanting to share their source of their tremendous wealth. If that is the case, we can expect an announcement from the Rajang Wood group before the next DUN sitting that they have resolved to bring in all the rural communities surrounding their oil palm plantations to become shareholders in their companies. That would be the test of their sincerity.
