2. PETROLEUM DEVELOPMENT ACT 1974 PDA’74
THE BILL LEADING TO THE PASSING OF THE PDA’74 WAS INTRODUCED IN PARLIAMENT WITH THE CONNIVANCE OF AN MP FROM SARAWAK WHO EVENTUALLY ROSED TO BECOME A CHIEF MINISTER AND ENDED UP AS THE TYT OF SARAWAK.
2.1 SARAWAK 5% OIL & GAS SALES TAX
THE PREMIER OF SARAWAK SAID THIS WAS ONE OF THE ALTERNATIVE SOURCE OF INCOME FOR SARAWAK.
ON THE 12TH JULY 2022, DEPUTY PREMIER DATUK SERI DR. SIM KHUI HIAN REVEALED THAT PETRONAS PAID THE 5% SALES TAX ON O&G BUT THE 5% ROYALTY AND 38% SHARE OF TAX UNDER PITA’67 REMAINS UNPAID. GPS ACHIEVEMENT HERE: F FOR FAIL
2.1 DISTRIBUTION RIGHTS OF PETRONAS LPG TANKS. SARAWAKIANS INITIALLY WERE UNDER THE IMPRESSION THAT SARAWAK WILL HAVE COMPLETE CONTROL OF THE DISTRIBUTION.

3. 12TH MALAYSIA PLAN & ANNUAL BUDGET
SARAWAK WAS SLATED TO BE ALLOCATED 15% OF THE TOTAL (RM400 BILLION) DEVELOPMENT FUND. 15% HARDLY QUALIFY TO BE DESCRIBED AS AN EQUITABLE SHARE FOR A REGION DESCRIBED AS AN EQUAL PARTNER IN THE FEDERATION. EQUITABLE SHARE SHOULD AT LEAST BE 33%.
THE TOTAL ALLOCATION FOR DEVELOPMENT UNDER THE 12MP IS RM400 BILLION, TOUTED AS THE BIGGEST 5-YEAR ROAD MAP EVER. TAKING THE 15% OF THAT MEANS SARAWAK SHARE OF THE DEVELOPMENT ALLOCATION IS RM60 BILLION. SPREAD OVER 4 YEARS, SARAWAK’S SHARE OF THE DEVELOPMENT ALLOCATION IN THE FEDERAL BUDGET SHOULD BE RM15 BILLION PER YEAR FOR 4 YEARS STARTING WITH BUDGET 2022 BUT SARAWAK’S ALLOCATION UNDER THE 1ST ROLLING PLAN OF THE 12MP WAS ONLY RM4.47 BILLION. WHAT WAS THE PROMISE FOR SARAWAK UNDER THE NATIONAL BUDGET 2022? THE PROMISE FOR SARAWAK UNDER THE BUDGET 2022 IS THE MIRROR IMAGE OF THE AMOUNT ALLOCATED UNDER THE 1ST ROLLING PLAN OF THE 12MP MENTIONED EARLIER. WHY IS THERE SUCH A HUGE DIFFERENCE BETWEEN THE PROMISED ALLOCATION UNDER THE 12MP AND THE ALLOCATION UNDER THE 1ST ROLLING PLAN AS REFLECTED IN THE BUDGET 2022? HOW DID IT HAPPEN? JUST IN CASE THERE ARE READERS WHO MISSED IT, THE DIFFERENCE IS MORE THAN RM10 BILLION. IN OTHER WORDS, SARAWAK HAS BEEN SHORT-CHANGED BY RM10 BILLION.
IN THE 2023 BUDGET, SARAWAK WAS ALLOCATED RM5.4 BILLION, COMPARED TO SABAH WHICH WAS ALLOCATED RM6.3 BILLION AND THE MALAYAN STATES EACH GETTING AN AVERAGE OF RM33.8 BILLION. GPS ACHIEVEMENT HERE: F FOR FAIL

1.1 EDUCATION STILL FIRMLY UNDER THE FEDERAL LIST IN THE FEDERAL CONSTITUTION.
THE CONSEQUENCES: HUNDREDS OF DILAPIDATED SCHOOLS IN SARAWAK REMAINS UNREPAIRED AND NOT UPGRADED AS PROMISED. INTAKE INTO TEACHERS TRAINING INSTITUTES IN S’WAK DO NOT HAVE PREFERENTIAL QUOTA FOR SARAWAKIANS. SCHOOLS IN SARAWAK ARE THE NEW EMPLOYMENT FRONTIER FOR TEACHERS FROM MALAYA.
BN/UMNO POSITION: SARAWAK NOT A PRIORITY
1.2 MEDICAL AND HEALTHCARE SERVICES IS FIRMLY UNDER THE FEDERAL LIST IN THE FEDERAL CONSTITUTION.
THE CONSEQUENCES: MANY HEALTH CLINICS, PARTICULARLY IN THE RURAL AND RURAL URBAN AREAS IN SARAWAK ARE IN DILAPIDATED STATE AND INCAPABLE TO PROVINDING TOP QUALITY MEDICAL SERVICES TO SARAWAKIANS IN THE AFFECTED AREAS.
BN/UMNO POSITION: SARAWAK NOT A PRIORITY
1.2 FEDERAL CABINET RECENTLY AGREED TO HAVE A REPRESENTATIVE FROM SARAWAK & SABAH TO BE ON LHDN BOARD OR DIRECTORS OF LHDN, AFTER KEEPING QUIET FOR 59 YEARS BN/UMNO POSITION: SARAWAK NOT A PRIORITY. CAN KEEP SARAWAK IN THE DARK AS REGARDS S’WAK RIGHTS.

LAW WAS PASSED IN PARLIAMENT
THE CONSEQUENCE: SARAWAK TERRITORIAL SEA WAS REDUCED FROM 12 NAUTICAL MILES TO 3 NAUTICAL MILES FROM SARAWAK SHORES.
2. PETROLEUM DEVELOPMENT ACT 1974 PDA’74
THE CONSEQUENCE:
WITH THE PASSING OF THE PDA’74 IN PARLIAMENT, SARAWAK LOST HER RIGHTS TO HER OIL AND GAS RESOURCES TO THE UMNO LED FEDERAL GOVERNMENT. THE ENORMOUS FINANCIAL RESOURCES FROM SARAWAK O&G WAS USED TO FUEL DEVELOPMENT IN MALAYA, WITH SARAWAK GIVEN ONLY A 5% ROYALTY.
THE MOST VISIBLE SIGN OF THAT TODAY IS PETRONAS TWIN TOWER.
2.1 PETRONAS AGREED TO PAY 2.1 (A) THE 5% O&G SALES TAX 2.1 (B) 38 % TAX COLLECTED UNDER THE PETROLEUM (Income Tax) ACT 1967 (PITA). 2.1 (C) 5% ROYALTY ON O&G THE CONSEQUENCE: WITH THE NON-PAYMENT OF THE ROYALTY AND THE SHARE OF TAX UNDER PITA’67 TO SARAWAK, BN/UMNO FEDERAL GOVERNMENT DEPRIVED SARAWAK OF AN ENORMOUS AMOUNT OF MONEY AND PREVENTING SARAWAK FROM CARRYING OUT MUCH DEVELOPMENT WORKS IN INFRASTRUCTURE AND UTILITIES LIKE TREATED TREATED WATER AND ELECTRICITY TO RURAL SARAWAK. 2.1 INITIAL IMPRESSION, PETRONAS AGREED TO SURRENDER THE RIGHTS TO SARAWAK’S PETROS. PETRONAS ENDED UP HAVING 41% STAKE IN THE COMPANY GIVEN THE DISTRIBUTION RIGHTS OF THE LPG TANKS IN SARAWAK. 3. 12TH MALAYSIA PLAN & ANNUAL BUDGET THE ABSOLUTE AMOUNT IN RINGGIT AND SEN WAS NOT STATED, JUST A RELATIVE FIGURE (15%) WAS MENTIONED. HOW MUCH S’WAK WILL ACTUALLY GET, ONLY HEAVEN KNOWS, DEPENDING UPON THE FEDERAL GOVERNMENT ABILITY TO PULL IN THE REVENUE. SINCE THE FORMATION OF MALAYSIA, S’WAK HAS NEVER BEEN GIVEN AN EQUITABLE SHARE IN THE YEARLY DEVELOPMENT FUNDS FROM THE FEDERAL BUDGET DESPITE THE DEVELOPMENT EXPENDITURES BEING FUELED BY MONEY FROM SARAWAK’S O&G. BN/UMNO POSITION HERE: SARAWAK IS NOT A PRIORITY AS IT IS NOT REALLY SEEN AS TANAH MELAYU. |
