Perdana Menteri Sarawak, Abang Johari berkata cadangan timbalan pengerusi Barisan Nasional Mohamad Hasan untuk Perjanjian Malaysia baharu "sepatutnya tidak dibangkitkan".

Beliau berkata "MA63 telah dipersetujui oleh nenek moyang negara dan menjadi asas kepada penubuhan negara."

“Kami tidak perlu membuat perjanjian baharu. Jika itu perjanjian baharu, ini bermakna anda membatalkan perjanjian lama. Jika anda membatalkan perjanjian lama, maka pembentukan Malaysia akan dipersoalkan,” katanya kepada pemberita di sini.

Presiden Parti Bersatu Sabah itu tidak bersetuju dengan Datuk Seri Mohamad Hasan dari Umno, yang mencetuskan perjanjian baharu itu, berkata MA63 — piagam yang menyaksikan kelahiran negara — adalah suci.

Ahli Majlis Tertinggi Parti Sarawak Bersatu, YB Baru Bian menegaskan bahawa "pindaan Perlembagaan Persekutuan tahun lepas secara berkesan telah melembagakan MA63 dan Laporan Jawatankuasa Antara Kerajaan, menurut pakar undang-undang perlembagaan Prof Emeritus Datuk Dr Shad Saleem Faruqi."

KESIMPULAN

 

1. Tanpa Perjanjian Malaysia 1963, Persekutuan Malaysia tidak akan lahir. Perjanjian antarabangsa ini telah didaftarkan dengan sewajarnya dengan Pertubuhan Bangsa-Bangsa Bersatu dan semua rakan kongsi yang menandatangani terikat untuk menghormati dan mematuhinya dengan sewajarnya.

2. Perjanjian Malaysia 1963 telah dimeterai hanya selepas SEMUA terma dan syarat yang dirundingkan telah dipersetujui bersama oleh semua pihak yang menandatangani.

3. Selepas itu, tanggungjawab Kerajaan Persekutuan adalah untuk memastikan pematuhan dan pelaksanaan terma dan syarat, seperti yang termaktub dalam Perjanjian Malaysia. Tidak perlu dikatakan bahawa ketidakpatuhan Perjanjian merupakan pelanggaran yang mesti diperbetulkan, dipulihkan atau dikembalikan dengan sewajarnya.

4. Bukan hak ahli politik untuk memutuskan sama ada Perjanjian Malaysia baharu perlu dirundingkan. Rakyat mesti bersuara dalam perkara yang berkaitan dengan MA63 sepertimana pandangan nenek moyang mereka telah dipastikan sebelum pembentukan Malaysia pada tahun 1963, walaupun ia bukan keputusan sebulat suara ketika itu.

5. Satu pungutan suara perlu diadakan untuk menilai pandangan rakyat di Negeri-Negeri Borneo untuk menentukan sama ada Sabah dan Sarawak masih akan MEMILIH untuk kekal dalam Persekutuan Malaysia atau pergi secara berasingan akibat pelanggaran dan perbezaan yang tidak dapat didamaikan sepanjang 59 tahun.

Perjanjian baru hanya boleh dirundingkan sekiranya rakyat memilih untuk meneruskan dan kekal dalam Persekutuan Malaysia.

Apabila semuanya gagal dan sekiranya rakyat memilih untuk meninggalkan Persekutuan, Kerajaan Persekutuan juga mesti menghormati kehendak mereka dan bertindak sewajarnya mengikut cara perundangan dan perlembagaan untuk membuka jalan kepada pemisahan bersama dan aman.

Pasak persegi tidak boleh dipaksa masuk ke dalam lubang bulat - ia tidak sesuai, bukan?

Itu untuk rakyat di Negeri-Negeri Borneo membuat keputusan, SEBELUM mana-mana 'TAWARAN BARU' jika mahu melihat cahaya mata.Sehingga itu, 'TAWARAN BAHARU' ialah 'TIADA URUSAN' di bawah 'TAWARAN SEBENAR' sedia ada - dalam semangat, dan menurut MA63.

‘Bekas Ketua Polis Negara (KPN) Tan Sri Abdul Rahim Mohd Noor telah memberi amaran kepada Umno bahawa konsesi kepada PAS, khususnya berhubung hudud kanun keseksaan Islam yang kontroversi, boleh kehilangan sokongan Sabah dan Sarawak.’

Beliau berkata Abdul Rahim telah menegaskan bahawa Persekutuan Malaysia tidak sekali-kali dimaksudkan sebagai sebuah negara Islam kerana jika ia berlaku, Sabah dan Sarawak tidak akan pernah bersetuju dengannya.

Bekas KPN itu juga berkata apabila gagasan Malaysia dicetuskan, agama adalah isu utama yang ditangani oleh Suruhanjaya Cobbold, kata Lim.

“Amaran bekas KPN perlu diberi perhatian serius kerana ia melibatkan salah satu prinsip asas pembinaan negara serta salah satu terma dan syarat asas bagi persetujuan Sarawak dan Sabah untuk membentuk Persekutuan Malaysia pada 1963.”

Walaupun bukti puding adalah pada makan, kita juga harus mengingatkan diri kita bahawa kita tidak boleh memiliki kek dan memakannya.

Begitu juga dengan Kerajaan dan Kepimpinan ‘Keluarga Malaysia’ kita.

Tiada dua cara mengenainya.

Sarawak’s Premier, Abang Johari said the suggestion by Barisan Nasional deputy chairman Mohamad Hasan for a new Malaysia Agreement “should not even have been brought up”.

He said “MA63 was agreed upon by the country’s forefathers and was fundamental to the establishment of the country.”

“We don’t need to make a new agreement. If it’s a new agreement, it means you invalidate the old agreement. If you invalidate the old agreement, then the formation of Malaysia would be questioned,” he said to reporters here.

The Tourism, Creative Industry and Performing Arts Minister, Datuk Seri Abdul Karim Rahmah Hamzah said “he is puzzled by the proposal from Barisan Nasional (BN) deputy chairman Datuk Seri Mohamad Hasan.”

“You see MA63 (Malaysia Agreement 1963) is a fundamental document which led to the formation of a nation (Malaysia). Before that there was no Malaysia.

The Parti Bersatu Sabah president disagreed with Umno’s Datuk Seri Mohamad Hasan, who mooted the new deal, saying MA63 — the charter that saw the nation’s birth — is sacred.

Parti Sarawak Bersatu’s Supreme Council Member, YB Baru Bian pointed out that “the amendment of the Federal Constitution last year effectively constitutionalised MA63 and the Inter-Governmental Committee Report, according to constitutional law expert Emeritus Prof Datuk Dr Shad Saleem Faruqi.”
“The rights of the Borneo States are set out in these documents and what we want is for these to be respected and for us to be given what has been promised to us.”

OUR CONCLUSIONS

1. Without the Malaysia Agreement 1963, the Federation of Malaysia would not have been born. This international treaty was duly registered with the United Nations and all signatory partners were bound to honour and comply with it accordingly.

2. The Malaysia Agreement 1963 was concluded only after ALL the negotiated terms and conditions were mutually agreed upon by all the signatory parties.

3. Thereafter, the onus on the Federal Government was to ensure compliance and implementation of the terms and conditions, as enshrined in the Malaysia Agreement. It goes without saying that non-compliance of the Agreement constituted a breach which must be rectified, restored or restituted accordingly.

4. It is not for politicians to decide whether a new Malaysia Agreement should be negotiated. The people must have a say in matters pertaining to MA63 just as the views of their forefathers were ascertained prior to the formation of Malaysia in 1963, notwithstanding that it was not even a unanimous decision then.

5. A referendum should be held to assess the views of the people in the Borneo States to determine whether Sabah and Sarawak will still CHOOSE to remain in the Federation of Malaysia or go separate ways due to the breaches and irreconcilable differences over the 59 years.

A new agreement can only be negotiated if the people choose to continue and remain within the Federation of Malaysia.

When all else fail and should the people opt to leave the Federation, the Federal Government must also respect their wishes and act accordingly in a legal and constitutional manner to pave the way for a mutual and peaceful separation.

A square peg cannot be forced into a round hole – it just doesn’t fit, does it ?

That’s for the people in the Borneo States to decide, PRIOR to any ‘NEW DEAL’ if it were to see the light of day.

Until then, the ‘NEW DEAL’ is a ‘NO DEAL’ under the existing ‘REAL DEAL’ – in the spirit of, and pursuant to MA63.

‘Former Inspector-General of Police (IGP) Tan Sri Abdul Rahim Mohd Noor had warned Umno that concessions to PAS, particularly over the controversial Islamic penal code hudud, could lose its Sabah and Sarawak support.’

“I am not shy to declare that I appreciated his warning that the federal government would not only lose the goodwill and support of the East Malaysian states, the latter may even agitate to leave the Federation if the government submitted to PAS’ demands to implement hudud, just to ensure that Umno remained in power,” he said.

He said Abdul Rahim had stressed that the Federation of Malaysia was never meant to be an Islamic country because if it was, Sabah and Sarawak would never have agreed to it.

The former IGP also said when the idea of Malaysia was mooted, religion was the main issue addressed by the Cobbold Commission, pointed out Lim.

“The former IGP’s warning should be given serious consideration as it concerns one of the bedrock nation-building principles of the country as well as one of the fundamental terms and conditions for Sarawak and Sabah’s agreement to form the Malaysian Federation in 1963.”

While the proof of the pudding is in the eating, we must also remind ourselves that we cannot have the cake and eat it.

Same applies to our Government and Leadership of ‘Keluarga Malaysia’.

No two ways about it.
